AGREEMENT TO OUR LEGAL TERMS

Welcome to Frogs in Mugs! We provide creative activities, community events, and scientific insights designed to foster connection, play, and empathy for families with children.

These Legal Terms are provided by Alexandra Teleru, owner of the Frogs in Mugs brand and platform, in cooperation with the Verein Frogs in Mugs. Collectively, we refer to ourselves as "Frogs in Mugs," "we," "us," or "our."

These terms govern your access to and use of:

The Site: frogsinmugs.com
Our Services: All digital products, guides, community memberships, and events.
The Web-App: Accessing app.frogsinmugs.com. Please note that the usage of the web-app is specifically governed by its own Terms of Use, which can be found directly within the app interface.

By accessing our Site or using our services, you agree to be bound by these terms.

1. OUR SERVICES

We provide the Services "as-is." While we want everyone to enjoy Frogs in Mugs, it is your responsibility to ensure that using our Site and App complies with your local laws. We are not tailored to meet specific industry regulations (like US-based HIPAA or FISMA); if your use requires such compliance, you may not use the Services.

2. INTELLECTUAL PROPERTY RIGHTS

Our Content: All materials on our Site, Web-App, and social media channels—including text, code, designs, graphics, and images—are owned by or licensed to Frogs in Mugs. These are protected by copyright and trademark laws.

Your License: We want you to enjoy our resources! We grant you a personal, non-exclusive license to access, download, or print our content solely for your own personal, non-commercial use.

Restrictions: You may not copy, sell, or exploit our content for business purposes without our written permission. If you are an educator or professional who would like to share our "Froggy" ideas, please reach out to us at hello@frogsinmugs.com.

3. USER REPRESENTATIONS

By using our Services, you confirm that:

You have the legal capacity and agree to comply with these terms.
You are not a minor (at least 18 years old).
You will not use the Services for any illegal or unauthorized purpose.
The information you provide to us is accurate and true.

4. PROHIBITED ACTIVITIES

To keep our community safe for everyone, you agree not to:

Misuse the Data: No systematic "scraping" or harvesting of our data to create a competing database.
Security Breaches: No attempting to bypass security features or interfering with the proper working of the Services.
Harmful Conduct: No harassing our team, disparaging the association, or uploading viruses/malicious code.
Commercial Exploitation: No using the Services for unauthorized advertising or competing business endeavors.
Content Abuse: No modifying, translating, or creating derivative works of our content without permission.

5. USER CONTRIBUTIONS & LICENSING

Your Submissions: If you send us feedback, ideas, or suggestions ("Submissions"), you agree that we can use them for any purpose (commercial or otherwise) without compensation to you. Responsibility: You are responsible for what you post. You confirm that your submissions do not violate the rights of others or any applicable laws.

6. THIRD-PARTY CONTENT

Our Site may link to other websites or display third-party content. We do not monitor or endorse these third parties and are not responsible for any content, accuracy, or privacy practices on their platforms. Use them at your own risk.

7. SERVICES MANAGEMENT

We reserve the right (but not the obligation) to monitor the Services for violations, take legal action if necessary, and remove or disable any content that is burdensome to our systems or violates these terms.

8. PRIVACY POLICY

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your data in accordance with the Swiss Federal Act on Data Protection (nDSG).

9. TERM AND TERMINATION

9.1 Duration of Terms: These Legal Terms shall remain in full force and effect while you use our Services.

9.2 Membership Cycle & Renewal: Membership in the Association follows a calendar year cycle (January 1 to December 31).

Automatic Renewal: Memberships for "Fördermitglieder" (Supporting Members) automatically renew for the following calendar year on January 1st.
Termination by Member: You may terminate your membership at any time by providing notice in writing via email to hello@frogsinmugs.com. Termination takes effect at the end of the current calendar year (December 31st).
Refunds: Membership fees are non-refundable. No pro-rata refunds are provided for terminations made mid-year.

9.3 Termination by the Association: We reserve the right to suspend or terminate your access to the Services (including member-only areas of the App) if you breach these Legal Terms or our Statutes, or fail to pay the annual membership fee after receiving a reminder.

10. GOVERNING LAW & DISPUTE RESOLUTION

Governing Law: These terms are governed by and interpreted in accordance with the laws of Switzerland.

Dispute Resolution: We aim to resolve any issues informally. Please contact us first. If an agreement cannot be reached, the Parties agree to submit to the jurisdiction of the courts of Zurich, Switzerland.

11. DISCLAIMER

Professional Disclaimer: The Services and Content provided are for informational and inspirational purposes only. They do not constitute medical or clinical psychological advice, nor are they a substitute for professional therapy.

Personal Responsibility: Use of play ideas and creative activities is at your own risk. Parents and caregivers maintain the sole duty of supervision (Aufsichtspflicht) over minors at all times during the implementation of our activities or attendance at workshops.

Technical Disclaimer ("As-Is"): The Services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by Swiss law, we disclaim all warranties and assume no liability for errors, bugs, or interruptions to the Services, or any damage resulting from unauthorized access to our secure servers.

12. LIMITATIONS OF LIABILITY

To the fullest extent permitted by Swiss law, our total liability for any claim arising out of these terms or the use of our Services shall be limited to the total amount paid by you for the specific Service (such as a guide or membership fee) in the calendar year of the incident. In no event shall the Board members of the Association be personally liable for the debts or obligations of the Association.

13. FINAL PROVISIONS & CONTACT

The Full Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Frogs in Mugs. For association members, the Statutes (Statuten) and Membership Regulations also apply and will take legal precedence in the event of a conflict.

Severability: If any part of these terms is found to be invalid or unenforceable, the rest of the terms will remain in full force and effect.
